If you wish to return the product you have purchased, you can do so in 2 ways within 14 calendar days from the issue of the receipt:

  1. Delivering it in its original condition and packaging in our physical store at 11 Frangon, holding the proof of purchase.
  2. Sending it at your own expense, in its original condition and packaging, to our physical store in Frangon 11, enclosing the purchase receipt.
  3. We can also pick up the product for return from your place with a charge of 4€ (valid for the urban complex of Thessaloniki).

Right of withdrawal from the distance contracts based on Law 2251/1994 (as amended by K.Y.A. Z1-891 / 2013) – Return of products

The Customer can easily return the products he has purchased from the online store because he simply changed his mind, within fourteen (14) days of receiving them . The Customer can deliver the products directly to the Smart Color store at 11 Frangon Street or send them at his own expense to the aforementioned address. In any case, for online orders, the Customer can contact Smart Color before returning the products either by phone at 2310 551160, or by sending an e-mail to sales@smartcolor.gr). In particular, the Customer has the above right to return a product purchased from the online store without stating the reasons, under the following terms and conditions:

(a) Within a period of fourteen (14) calendar days from the date of conclusion of the service contract (when it comes to services) or from delivery (when it comes to products) or its receipt (when the Customer has chosen “receipt from the store ») And in case of many goods ordered by the Customer with an order and delivered separately from the time of receipt and the latter, the Customer is entitled to withdraw from the sale (hereinafter” Return “).

(b) This withdrawal is unjustified and the Customer must return the product in the  same impeccable condition received . In particular, the returned product should not have been used, it should be in excellent condition (“as new”), just like before its sale, in its complete original packaging (box, nylon, foam, etc.). which should not have tears or damage) and with all the contents of the original packaging (instructions for use, features and warranties, connection cables, installation software, etc.). In addition, in order for the product to be accepted, the original purchase document (retail receipt, invoice) must be displayed by the person who originally purchased the product and whose details are recorded in the purchase document.

(c) The return of the item is accepted only if the Customer has previously paid any amount charged to SMART COLOR for the shipment of the product to him and the shipping costs for his return.

(d) The Customer is obliged to return the products within fourteen (14) calendar days from the day on which he notified the withdrawal to any Natural Public store. SMART COLOR, if the Customer wishes, can pick up the product to be returned from the Customer’s place, with a charge of the latter amounting to € 4.

(e) Following the declaration of withdrawal, SMART COLOR is obliged to return to the Customer the price received. In the event that the Customer charges a credit card, SMART COLOR, if it has received the price from the Bank, will be obliged to inform the Bank of the cancellation of the transaction and the Bank will take any action. SMART COLOR, after being informed of this, bears no responsibility for the time and manner of execution of the dispute, which is regulated by the contract drawn up between the issuing bank and the Customer. In case the Customer had chosen the option “receipt from the store”, the refund will be made by the SMART COLOR store.

(f) The refund of the price due to withdrawal to the Customer will be made no later than fourteen (14) working days from the time when SMART COLOR received proven knowledge of its withdrawal.

(g) Delivery costs will not be refunded unless the Customer has chosen a delivery method other than the free delivery method offered by SMART COLOR.

(h) The Customer is liable to compensate SMART COLOR if it has used other than that which is necessary for the determination of the nature, characteristics and operation of the goods in the period until the declaration of withdrawal, and SMART COLOR is entitled to agree with the Customer to compensate her even with mutual compensation. In case the withdrawal concerns the provision of services, the Customer must pay an amount proportional to the ones provided until the declaration of withdrawal. If the Customer exercises the right of withdrawal any concluded contracts expire automatically, at no cost to the Customer.

(i) Products that have been sold with an additional gift (eg free memory, etc.) must be returned together with the extra gift, otherwise the value of the gift will be deducted from the refunded amount.

7. Exceptions to the Right of Return of par. 6

The right of withdrawal from article 4 § 10 of law 2251/1994 does not apply:

    • In cases where the price of the products has been paid in the physical store of Smart Color and in addition, the products have been received from the physical store of Smart Color, as the sale is not considered to have been made remotely .
    • Products that are not suitable for return , for reasons of health protection (eg headphones, hands free, etc.) or for reasons of hygiene, and which have been unsealed after delivery, such as personal care items.
    • Products used , e.g. have been personalized by registering the device (smartphones).
    • Sealed audio documents or sealed video documents or sealed computer software , sealed after delivery and in particular: a) open digital memory and USB storage media, b) open consumables (ink, paper, CD), DVD, etc. c) open programs / software, d) mobile devices if their packaging has been opened, e) products that are missing the serial number, f) computers and other custom products (Built-To-Order).
    • Service agreements after the full provision of the service if the execution began with the prior explicit consent of the Customer, and with his acknowledgment that he will lose the right of withdrawal as soon as the contract is fully executed by SMART COLOR.
    • In cases of supply of digital content not provided on a material medium , if the execution began with the previous explicit consent of the Customer and his confirmation that he loses the right of withdrawal.

8. Claims due to defect or lack of contracted property

The Withdrawal of par. 10 of the present does not concern defective products or products in which there is a lack of contractual capacity, which are covered by their respective guarantees.

8.1. Responsibility of the Seller for real defects or lack of agreed properties

In the event that SMART COLOR is liable for a defect or a defect in the quality of the product (” legal warranty “), the Customer is entitled to: a) demand, without charge, the correction or replacement of the product with another, except if such action is impossible or requires disproportionate costs, (b) request a reduction in price or (c) withdraw from the contract of sale, unless it is a substantial actual defect. In order for a property to be considered contracted, it must have been agreed in writing. If the Customer chooses to correct or replace the product, SMART COLOR must make a correction or replacement in a reasonable time.

In any case, if the Customer finds a defect, he has the opportunity to contact the online store immediately after delivery on the same day or the next working day at 2310 551160 or at the email sales@smartcolor.gr. If a product is declared defective by the Customer, SMART COLOR is expressly reserved for the prior diagnosis of the product as defective by competent technicians.

Limitation of Liability : SMART COLOR is relieved of the above obligations if it notifies the Customer and so he knew the defect or defect in the product. In addition, SMART COLOR does not provide warranty or warranty protection for any product for any specific purpose.

8.2. Liability and Guarantee of Supplier

New products with a long shelf life (“permanent consumer goods”) must be accompanied by a written warranty (“commercial warranty”) of the manufacturer of the product or the company that imported the product into the EU or the company that appears as the manufacturer (“Supplier” ). The basic terms of the trade guarantee are as follows:

(a) The Supplier must provide the final Customer in writing, in Greek or with internationally established symbols, clear and complete instructions for safe use, safekeeping, maintenance and full utilization of the product and information on hazards during use and maintenance. . The guarantee must include, in simple, legible and understandable wording in the Greek language, at least the name and address of the guarantor, the product to which the guarantee refers, its exact content, its duration and the extent of its territorial validity. The warranty must comply with the rules of good faith and must not be invalidated by excessive exceptions. The warranty period must be reasonable in relation to the time at which these products are expected to remain technologically up-to-date, if this time is shorter than their possible lifespan.

(b) If a defect occurs in the product during the warranty period and the Supplier refuses or delays the repair beyond the time required, the Customer is entitled to request the replacement of the product with new features and quality or if it is not repaired to request withdrawal from the contract. If the required repair time exceeds fifteen (15) working days, the final Customer is entitled to request the temporary replacement of the product for as long as the repair lasts. Violation of the obligations of the Supplier by the Supplier does not affect the validity of the guarantee, which the Customer can invoke and demand from the Supplier its observance.

(c) In addition to the warranty, the Supplier of new permanent consumer goods must ensure to consumers the continuous provision of technical services for their maintenance and repair for a period of time equal to their possible lifespan. The products available from SMART COLOR are accompanied by written instructions for use and a written guarantee of good operation of reasonable duration, in the Greek language. The warranty form always includes the name and address of the manufacturer, the product to which the warranty refers, its exact content, its duration, its local scope of validity, and the rights provided by applicable law. SMART COLOR, as long as it is a Supplier in accordance with the above, encloses in its products with long life, the conditions that concern their safe use and maintenance, and with which the final Customer must comply. The warranty of each permanent consumer product has a duration according to the manufacturer from the date of purchase and allows the free restoration of the problem, if:

  • there is the dealer’s warranty and the device purchase receipt
  • the fixed elements of the device (Serial No.) have not been altered and
  • the damage is not excluded on the basis of the manufacturer’s warranty form.

Refurbished PROGRAM

The above does not apply to products participating in the “Refurbished” program. For these products, which are not new but used, a limited warranty period is provided by the manufacturer, according to the specifics specified on the product’s website. The devices participating in the Refurbished program are used and may have visible or non-visible scratches / abrasions on the front and rear housing. The package does not contain instructions for use.

9. Personal Data

The Customer fills in personal information (eg name, e-mail address, telephone) in the special Order Form available in the online store, in order to submit to SMART COLOR (otherwise “us” ) his order for products. SMART COLOR, as Editor-in-Chief, collects the information required by the Customer (“personal data” or “Data”) that is absolutely necessary for the above transactions. The Customer’s Data is retained by SMART COLOR for the required time. for the fulfillment of the contract of sale with the Customer and however for a period not exceeding five years from the termination or expiration of this contract, as defined by law for the limitation of any claims and for reasons of liquidation. The tax data as well as what is required for control purposes by the supervisory authorities will be observed as defined by the current legislation. They will then be safely destroyed, provided that they are no longer required to meet the above purpose or to meet the business, tax, or accounting requirements of SMART COLOR or to defend their rights before a Court or Authority. . Access to Customer Data is provided by the absolutely necessary staff of SMART COLOR, which has committed itself to maintaining confidentiality and the companies cooperating with us, which process the Data as Executors of the Processing on our behalf and in accordance with our orders.
